By accessing or using Scoopilot (the "Service"), a platform operated by Servicd ("Company," "we," "us," or "our"), you ("Subscriber," "Pilot," or "User") agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
1. The Service
Scoopilot provides business management software, automated routing, and AI-driven voice reception services ("Voice AI"). The Service is provided on a subscription basis for business use only.
2. Subscriptions, Trials, and Pricing
- Plans and Automatic Renewal: Subscriptions are billed monthly in advance and renew automatically until cancelled. You authorize recurring charges to your payment method at the price and in the currency disclosed at checkout, plus applicable taxes and usage charges.
- Cancellation: To cancel, contact us using the contact details below before your next renewal. Cancellation takes effect at the end of the current paid billing period, and access continues until then. Software and Voice AI are separate subscriptions; identify each subscription you wish to cancel. Cancelling one does not automatically cancel the other. Usage charges incurred before cancellation takes effect remain payable.
- Software Plans: Start, Solo, Crew, Fleet, and Operator include unlimited clients. Operator includes unlimited users; extra-user charges apply beyond the included seats on other plans as shown on the pricing page.
- Trial: Software plans include a 14-day free trial. A card is required, and software billing begins automatically after the trial unless you cancel before it ends. If you cancel during the trial, software access ends when the trial expires and no software subscription fee is charged. Optional Voice AI subscriptions are billed immediately and separately and are not covered by the software trial.
- Voice AI Pricing: Monthly USD prices are $10 for Voice Starter, $69 for Scooper Voice, $129 for Scooper Pro, and $229 for Fleet Voice. These prices do not require a software subscription.
3. Usage-Based Billing & Overages
Certain features of the Service are subject to usage limits. By using these features, you authorize us to charge your payment method on file via Stripe for any overages incurred during the billing period.
- Voice AI Minutes: Voice Starter includes 10 minutes with US$0.75 per additional minute; Scooper Voice includes 75 minutes with US$0.49 per additional minute; Scooper Pro includes 150 minutes with US$0.39 per additional minute; Fleet Voice includes 350 minutes with US$0.25 per additional minute. All calls are rounded up to the nearest whole minute for billing purposes.
- SMS Messaging: Software plans include 50, 150, 300, 500, and 1,250 SMS segments per month for Start, Solo, Crew, Fleet, and Operator respectively. Additional SMS segments cost US$0.07 or CA$0.10. Allowances and overages are measured in segments, not individual messages.
- Calculations: Usage is calculated based on data provided by our telephony and AI partners (Retell/Twilio). Our internal logs are the definitive record for billing purposes.
4. AI Voice Agents and Compliance
- Recording Disclosure: You acknowledge that Voice AI interactions are recorded. It is your sole responsibility to comply with local, state, and federal "call recording" laws. You agree to ensure your Voice AI script includes a disclosure (e.g., "This call is recorded") if required by your jurisdiction.
- AI Limitations: While our AI is designed to qualify leads and book jobs, we do not guarantee the accuracy of every interaction. Scoopilot is not liable for missed bookings or errors made by the AI agent.
5. Fees and Payment
- Subscription Refunds: Subscription fees are non-refundable except where required by applicable law. Cancellation does not entitle you to a prorated refund or credit for unused time in a paid billing period. This policy does not limit any mandatory statutory rights.
- Setup Fees: Self-service voice setup is included. Optional done-for-you implementation: US$49 one time (regularly US$99) through December 31, 2026. US$99 from January 1, 2027. This optional implementation fee is non-refundable once the custom AI script configuration has begun, except where required by applicable law.
- Non-Payment: If a recurring payment fails, we reserve the right to pause your Service, including the deactivation of your AI Voice Agent, until the balance is cleared.
6. Data Ownership
- Your Data: You retain all rights to the customer data and call transcripts generated through your account.
- Our License: You grant us a limited license to process your data to provide the Service as described in our Privacy Policy. Only anonymized data that does not identify you, your customers, or callers may be used to train or improve AI models. Identifiable customer records, call recordings, and transcripts are not authorized for model training by this clause. We will not attempt to re-identify anonymized training data.
- Retention and Export: You may request a copy of your data before access ends. After your subscription ends, account data, including recordings and transcripts, may be retained for up to 90 days for account recovery and then deleted, except records required for legal, tax, security, or dispute-resolution purposes. Deletion requests are subject to these retention requirements. Anonymized data that can no longer be linked to you or an individual may be retained for model improvement.
7. Limitation of Liability
To the maximum extent permitted by law, Servicd and Scoopilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit or revenue, arising out of your use of or inability to use the Service. Our total aggregate liability shall not exceed the fees you paid us in the three months preceding the claim. These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited.
8. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes shall be resolved in the courts of Loudoun County, Virginia, subject to any mandatory rights under applicable law.
9. Related Policies, Changes, and Contact
Our Privacy Policy describes how we handle personal information, and our End User License Agreement governs your software license. These Terms control subscription pricing, renewal, cancellation, and refunds if wording in the EULA conflicts. Mandatory legal rights remain unaffected.
We will notify subscribers by email of material changes to these Terms or subscription prices before they take effect. Price changes apply to a future renewal, not retroactively to a paid billing period. You may cancel before the affected renewal.
